Every Wednesday, Sara happily tods to BLAW class. From 9am onwards, Sara breezes thro' Mr Randall's class with "huhs", "er Mr Randall can u repeat ur questions again" and tutorial ans so similar to Mr Randall's ans right down to the .s and ,s. But of course there are times when Sara writes her own answers too.
You'll know that when Mr Randall says,
"that is the best ans I've gotten for the whole wk :) "

Judicial Management One basic aim of judicial management is to rehabilitate the company. During such rehabilitation, the company is shielded from legal actions against it and its assets. Creditor is prevented to partition the company from winding-up for 6 months so that the company can trade its way out. Judicial management stands out to benefit the members (co. can still carry on) and creditors (better chance of being paid).

Question 3 Explain what is meant by misrepresentation. List and describe briefly the three types of misrepresentation. Misrepresentation is a false statement of fact made by one party in the course of negotiations which induces (encourages) the other party to enter into the contract. Fraudulent misrepresentation is a false statement made knowingly. Example, Sara buys a necklace from Elaine. Sara tells Elaine, she will not buy anything made in Singapore. Elaine intentionally deceives Sara when Elaine knows that the necklace is made in Singapore but says no or says they are made in USA. Elaine is liable for fraudulent misrepresentation. Negligent Misrepresentation is a false statement made without care and has no reasonable grounds to believe but has no fraudulent intent.Example, Sara buys a necklace from Elaine. Sara asks if the necklace is made in Singapore. Elaine does not know and she does not check and says no. Elaine is liable but not as much as Fraudulent Misrepresentation. Innocent Misrepresentation is a false statement without fault and made without fraud and has reasonable grounds to believe.Example, Sara buys a necklace from Elaine. Sara asks if the necklace is made in Singapore. Elaine shows a third party inspection certificate that says the necklace is made in USA. However, the third party did not check properly and the necklace is actually made in Singapore. Elaine is still liable but not as much as Fraudulent Misrepresentation and Negligent Misrepresentation.
